1. About these terms

This website is operated by barva kopel, a fictitious business name of Berell Inc., a California corporation ("barva kopel", "we", "us" or "our"). These Terms of Service ("Terms") apply when you visit our website, reserve a product, or buy from us. By using the site or placing an order, you agree to these Terms and to the policies linked below. Our store runs on Shopify.

2. Using our site

You must be at least the age of majority where you live to place an order, or have a parent or guardian's permission. Please don't use the site for anything unlawful, try to interfere with how it works, or copy or scrape its content.

3. Products, prices and availability

We work hard to describe and photograph our products accurately, but colors can look different on different screens. Prices are shown in U.S. dollars unless stated otherwise and may change. If we find an error in a price or description, we may correct it, and if the error affects an order you've placed, we'll contact you and let you choose to continue at the correct price or cancel for a full refund.

We may limit quantities per customer, and we may decline orders that appear to be placed by resellers. Authorized dealers buy through our wholesale program instead.

4. Reservations

Before a new batch arrives, you may be able to reserve a rod with your email address. A reservation costs nothing and is not a purchase or a contract to buy. Nothing is charged, and you don't have to buy. When the rods are ready, we'll email you a private link to buy before the public release. Reservations don't guarantee a rod if the batch sells out, and we'll tell you if that happens.

5. Preorders

When a product is sold as a preorder, the expected ship date is shown on the product page and at checkout, and your payment is charged when you place the order. If we can't ship by that date, we'll email you before it passes with a revised date and the option to cancel for a full refund. You can cancel a preorder any time before it ships for a full refund.

6. Orders and payment

Your order is an offer to buy. We accept it when we ship it or send a shipping confirmation. We may cancel an order, for example if a product is unavailable or we suspect fraud, and if we do, we'll refund any amount you paid. Please give accurate contact, billing and shipping details. Payments are processed securely by our payment providers, and we don't store your full card details.

7. Shipping, returns and refunds

Shipping is covered by our Shipping Policy, and returns and refunds by our Refund Policy.

8. Warranty

Our rods come with the written 6-Month Limited Rod Warranty. Any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited to the 6-month length of that written warranty, to the extent the law allows. Some states don't allow limits on how long an implied warranty lasts, so this limit may not apply to you. The warranty gives you specific legal rights, and you may also have other rights that vary from state to state.

9. Safe use

Fishing near water carries natural risks. Please follow local fishing rules, wade carefully, and use our products as described, within each model's rated line and lure weights.

10. Limitation of liability

To the extent the law allows, barva kopel is not liable for indirect, incidental, special or consequential damages, such as lost profits, arising from your use of the site or our products, and our total liability for any claim about a product is limited to the amount you paid for it. Some states don't allow these exclusions or limits, so they may not apply to you. Nothing in these Terms limits our liability for personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law.

11. Our content and trademarks

The text, photos, videos and designs on this site belong to barva kopel or are used with permission. "barva kopel" and "Brucke" are our brand names. Please don't use them, or copy our content, without our written permission.

12. Reviews and feedback

If you post a review or send us feedback, please keep it honest and lawful. You allow us to display and share it in connection with our products, and we may remove content that is unlawful, offensive or misleading. We never edit a review to change its meaning.

13. Third-party links

Our site may link to other websites, such as YouTube. We aren't responsible for their content or practices, so please check their terms and privacy policies.

14. Privacy

How we handle your personal information is explained in our Privacy Policy.

15. Governing law

These Terms are governed by the laws of the State of California, United States. If you are a consumer, nothing in these Terms takes away rights you have under the consumer laws of the place where you live, including the right to bring a claim in your local courts.

16. Changes to these terms

We may update these Terms from time to time. The version posted on this page, with its "Last updated" date, applies to orders placed after that date.
